Urban Culture is a website located at urbanCulture.me, or urban Culture mobile application (collectively, “Urban Culture Platform”) and operated by HYS & BEAUTY PRIVATE LIMITED (“Urban Culture”, “Company”, “we”, “us” and “our”) a company duly registered and incorporated under the Companies Act, 1956. The company is strongly committed in protecting your privacy and has taken all necessary and reasonable measures to protect your personal information and handle the same in a safe and responsible manner in accordance with the terms and conditions of this policy (“Privacy Policy”).

The terms “you” and “your” refer to the user of the urban Culture Platform. The term “Services” refers to any services offered by urban Culture whether on the urban Culture Platform or otherwise.

Please read this Policy before using the Urban Culture Platform or submitting any personal information to Urban Culture. This Policy is a part of and incorporated within, and is to be read along with, the Terms of Use. The information contained in this Website and the personal information collected by using/login and or accessing this Website and application are stored at a secured server. It is stated by the server service provider that they have all the best security practices required for the server. The Website and application are owned by an Indian company and are located in India. Hence, we are duty bound to abide by the laws, regulations, rules, circulars, notifications, etc., governing privacy in India. This Privacy Policy is applicable to all users of this Website and application. The user is herein collectively referred to as “You”. You may note that this Privacy Policy may be found deficient with respect to certain privacy laws of some other countries. By visiting this Website you agree to be bound by the terms and conditions of this Privacy Policy. If you do not agree, please do not use or access our Website. YOUR CONSENT

By using the Urban Culture Platform and the Services, you agree and consent to the collection, transfer, use, storage, disclosure, and sharing of your information as described and collected by us in accordance with this Policy. If you do not agree with the Policy, please do not use or access the Urban Culture Platform.

Permissible Age

The Services are not intended for users under the age of 18, unless permitted under applicable local laws (Permissible Age). We do not knowingly collect any personal information from users or market to or solicit information from anyone under the Permissible Age. If we become aware that a person submitting personal information is under the Permissible Age, we will delete the account and any related information as soon as possible. INFORMATION WE COLLECT FROM YOU

(a) For availing the Services/Products from our platform or to contact Urban Culture, you may have to sign up by giving the following personal information such as your name, email, phone number, OTP, address, date of birth, and profile picture. Some of this information provided above is personally sensitive information (“Personal Information”) and is collected for the purpose of verification of the identity of the user and to ensure due compliance. We do use your contact information to send you offers based on your previous orders and your interests.

(b) When you use our Services, we may collect and store information about you to process your requests and automatically complete forms for future transactions, including (but not limited to) your phone number, address, email, billing information, and credit or payment card information.

Service Professionals

(a) If you sign up to join as a service Professional, we may collect (information not limited to) your name, email address, phone number, gender, date of birth, location details, address, copies of government identification documents and other details (KYC), call and SMS details, including photographs and videos. We also may collect payment information, such as credit card information, from you.

(b) Background Verification: The Service Professional acknowledges that as part of the on-boarding process, background checks may be conducted.

(c) Urban Culture reserves the right to record the conversations between service professionals and consumers facilitated by Urban Culture through the messaging/chat mechanism on the platform or the calls. All the chat/messaging logs or call recordings can be used but are not limited to monitoring and prohibiting abuse, safeguarding the rights of consumers and service professionals, and resolving disputes.

(d) Location data (Partner and delivery person): We collect precise and approximate location data from the mobile devices of Service Professionals (Partners) when the Urban Culture app is running in the foreground or background. This ensures smooth operations, safety, and security, and helps to optimize service distribution and lead management. Location data is collected with partner consent, stored securely, and shared only as needed for service delivery and internal system management. No third-party sharing occurs outside these purposes.

Information collected from your mobile device

(a) Cookies: We and our third-party service providers collect information from you by using cookies. A cookie is a small file stored on the user's computer hard drive containing information about the user. The cookie helps us analyze web traffic or informs you about your use of a particular website. Cookies allow web applications to respond to you as an individual.

(b) Contacts: We use read-only information to authenticate you to log into the service. We will never import or scan your contacts unless you ask us to. If you opt to do so, we request access to your contacts to help you find your friends who use Urban Culture.

(c) Location: We gather or use your specific device location to identify available services in your area.

(d) Camera: We will only access images that you specifically choose, and we will never scan or import your photo library or camera roll. This allows you to choose individual pictures to change your user profile picture or easily upload documents. You can stop sharing photos and revoke access at any time.

(e) Device Information: In order to improve your app experience and lend stability to our services, we may collect information or employ third-party plugins that collect information about the devices you use to access our Services, including hardware models, operating systems and versions, software, file names and versions, preferred languages, unique device identifiers, advertising identifiers, serial numbers, device motion information, mobile network information, installed applications on devices, and phone state. The information collected thus will be disclosed to or collected directly by these plugins and may be used to improve the content and/or functionality of the services offered to you. Analytics companies may use mobile device IDs to track your usage of the Urban Culture Platform

(f) Usage data: We collect data about how users interact with our services. This includes access dates and times, app features or pages viewed, browser type, and app crashes and other system activity.

(g) Communications data: We collect data regarding communications between users that are enabled through Urban Culture’s apps/web. This includes communication type (phone, text or in-app message), date/time, and content (including recordings of phone calls for quality assurance, training, and compliance purposes).

(h) Technical Data: which includes your IP address, browser type, internet service provider, details of operating system, access time, page views, device ID, device type, frequency of visiting our website and use of the Platform , website and mobile application activity, clicks, date and time stamps, location data, and other technology on the devices that you use to access the Platform.

(i) Transaction information: We collect transaction information related to the use of our services, including the type of services requested or provided; Booking or order details (such as date and time, addresses, distance and items ordered, other service items); and payment transaction information (Merchant's name and location, amount charged, and payment method). We also associate a user’s name with that of anyone who uses their promotion code.

USES OF YOUR INFORMATION

We use the information we collect for the following purposes, including:

(a) To provide, personalize, maintain, and improve our products and services, such as to enable deliveries and other services, enable features to personalize your Urban Culture account.

(b) To carry out our obligations arising from any contracts entered into between you and us and to provide you with the relevant information and services.

(c) To administer and enhance the security of our Urban Culture Platform and for internal operations, including troubleshooting, data analysis, testing, research, statistical, and survey purposes.

(d) To provide you with information about services we consider similar to those that you are already using, or have enquired about, or may interest you. If you are a registered user, we will contact you by electronic means (e-mail or SMS or telephone) with information about these services.

(e) To understand our users (what they do on our Services, what features they like, how they use them, etc.), improve the content and features of our Services (such as by personalizing content to your interests), process and complete your transactions, make special offers, provide customer support, process and respond to your queries.

(f) To generate and review reports and data about, and to conduct research on, our user base and Service usage patterns.

(a) With professionals: We may share your information with our professionals, research firms, and other service providers or business partners, such as Payment processing companies. We also may use vendors for conducting surveys or organizing sweepstakes for us.

(b) With Academic Partners: We may share your information with our academic partners for the purpose of carrying out academic research.

(c) With Advertisers and advertising networks: We may work with third parties such as network advertisers to serve advertisements on the Urban Culture Platform and on third-party websites or other media (e.g., social networking platforms). These third parties may use cookies, JavaScript, web beacons (including clear GIFs), Flash LSOs, and other tracking technologies to measure the effectiveness of their ads and to personalize advertising content to you.

While you cannot opt out of advertising on the Urban Culture Platform, you may opt out of much interest-based advertising on third party sites and through third party ad networks (including DoubleClick Ad Exchange, Facebook Audience Network and Google AdSense). Opting out means that you will no longer receive personalised ads by third parties ad networks from which you have opted out, which is based on your browsing information across multiple sites and online services. If you delete cookies or change devices, your opt out may no longer be effective. To fulfil the purpose for which you provide it. We may share your information other than as described in this Policy if we notify you and you consent to the sharing.

Our commitment to Personal Information security

We recognize that your privacy is important to you, and therefore we endeavor to keep your Personal Information confidential. We will take reasonable technical and organizational precautions to prevent the loss, misuse, or alteration of your Personal Information. We assure you of our best effort to protect Personal Information. Please be aware that the transmission of information via the internet is not completely secure. Although we will do our best to protect your personal data, we cannot guarantee the security of your data transmitted through the Urban Culture Platform. Once we have received your information, we will use strict physical, electronic, and procedural safeguards to try to prevent unauthorized access.

Review, Change, or Account Deletion

(a) If you would like to review, change, or delete personal information we have collected from you, or permanently delete your account, please contact the Urban Culture Data Protection Officer (DPO) or go to: https://urbanculture.me/delete-account

(b) If you delete your User Contributions from our websites, copies of your User Contributions may remain viewable in cached and archived pages, or might have been copied or stored by other users of our websites. Proper access and use of information provided on our websites, including User Contributions, is governed by our Terms of Use.

(c) If you wish to delete your account, please note that this action is irreversible. Your customer rating will be reset. If you have made a transaction with the company, we will retain some of your data related to your transactions due to regulatory compliance and fraud prevention measures. If you haven’t made any transactions with the company, your account and all associated data will be deleted in accordance with our data deletion policy.

Payment Gateway:

Information relating to electronic transactions entered into via the Website shall be protected by encryption technology. We have partnered with secure payment gateways i.e., Paytm, PhonePe & Razorpay gateway. The Website does not have the ability to interfere and does not interfere with the payment gateway mechanism. The Website has no access to the information that you may enter for making the payment through the payment gateway. Your transaction and banking details or other information as required for internet banking or other payment instruments are held by our Payment Gateway partner. By creating a link to a payment gateway, we do not endorse the payment gateway, nor are we liable for any failure of products or services offered by such payment gateway. Such payment gateway may have a privacy policy different from that of ours. All failures/errors/omissions of the payment gateway shall be solely on the payment gateway. You hereby consent that you shall not sue the Website for any disputes that you may have with the payment gateway for any wrongdoing of the payment gateway.

Cancellation and Refund Policy

(a) Cancellation by Customer: You can cancel your booking up to 4 hours before the scheduled service time at no charge. Cancellations within 4 hours may incur a 30% fee. Once the service professional arrives at your location, cancellations are not allowed, and full charges apply.

(b) Cancellation by Urban Culture: If Urban Culture cancels or reschedules due to unforeseen circumstances, you will be notified, and a full refund will be provided if rescheduling is not possible.

(c) Refund Policy: Refunds will be processed within 5-7 business days for eligible cancellations. In case of dissatisfaction, report the issue within 24 hours of service completion for a possible partial refund or complimentary service.

(d) Non-Refundable Items: Products that are opened or used are non-refundable.

Security:

We safeguard your privacy using known security standards and procedures and comply with applicable privacy laws. Our Website combines industry-approved physical, electronic, and procedural safeguards to ensure that your information is well protected through its life cycle in our infrastructure. Personal Information is hashed or encrypted when it is stored in our infrastructure. Personal Information is decrypted, processed, and immediately re-encrypted or discarded when no longer necessary.

Opt-Out Policy:

When you sign up for an account, you are opting in to receive emails from Urban Culture. You can log in to manage your email preferences or you can follow the “unsubscribe” instructions in commercial email messages, but note that you cannot opt out of receiving certain administrative notices, service notices, or legal notices from Urban Culture.

If you wish to withdraw your consent for the use and disclosure of your personal information in the manner provided in this Policy or you want your data to be deleted, please write to us at [email protected]. Please note that we may take time to process such requests, and your request shall take effect no later than 5 (Five) business days from the receipt of such a request, after which we will not use your personal data for any processing unless required by us to comply with our legal obligations. We may not be able to offer you any or all Services upon such withdrawal of your consent.

We assure you that we shall proactively address your concerns. All disputes between us and you in this regard are subject to the exclusive jurisdiction of Jaipur courts.
